尊敬的阁下,

2013年2月2日,著名的维吾尔知识分子伊力哈木·土赫提先生及其十几岁的女儿在北京首都机场被公安人员阻止登机前往美国。伊力哈木·土赫提是位于北京的中央民族大学的学者,并一直为中国维吾尔人的权利发言。因其倡导行为,他曾被拘留过无数次。

据报道称,2013年2月2日上午8:45左右伊力哈木·土赫提以及他十几岁的女儿在北京首都机场过安检时被扣。他俩原本打算前往美国,伊力哈木计划在印第安纳大学做为期一年的访问学者。父女俩被带到审讯室扣押,并遭受了漫长的盘问。然而,最终他女儿被允许登上飞往美国的航班。伊力哈木告诉记者,他一直被扣押到当晚9时才被送回北京的家里。盘问他的警员没有对此给出任何理由和解释。

伊力哈木在北京一直成为监控、审讯及软禁的对象。他和他的家人之前也曾被禁止出远门。2012年10月,中共十八大前夕他被带到新疆的家里。据他透露,2010年他一共八次被阻止前往国外参加学术会议。

2006年,伊力哈木·土赫提建立了温和的“维吾尔在线”网站,用维吾尔语和汉语讨论包括维汉民族关系在内的社会问题。2009年新疆发生暴力骚乱造成了200人死亡,中国当局指控他的网站起了煽动作用。在此之后,网站被关闭,警方指责伊力哈木为分裂分子并多次盘问伊力哈木。目前,“维吾尔在线”在国外运行,但在中国大陆被封。

我相信,人权捍卫者伊力哈木·土赫提被禁止出境与他捍卫人权中所作出的努力以及他行使言论自由权利有直接关系,这公然剥夺了他自由行动的权利。

我要求中国当局:

1,立即并无条件地解除针对伊力哈木·土赫提的禁止出境令,因为他被禁止出境与他合法及和平的人权倡导行为有关。

2,保证中国所有人权捍卫者在任何情况下能够进行合法的人权活动,而不必担心遭到报复或遭到包括司法骚扰在内的限制。

On 2 February 2013, prominent Uyghur intellectual Mr Ilham Tohti and his teenage daughter were prevented from boarding a flight bound for the United States at Beijing Capital Airport by a number of security officials. Ilham Tohti is a professor at the Central University for Nationalities in Beijing and has been consistently outspoken on Uyghur rights in China. He has been detained numerous times previously as a result of his advocacy.

At approximately 8.45am on 2 February 2013, Ilham Tohti and his daughter were reportedly detained as they were going through security clearances at Beijing Capital Airport. The two were due to fly to the United States where Ilham Tohti was to take up a year-long position at Indiana University. He and his daughter were taken to interrogation rooms at the airport and questioned for a lengthy period of time. While his daughter was eventually permitted to board a US-bound flight, Ilham Tohti told reporters he was held until 9pm that evening before being sent back to his Beijing residence. He was provided with no information by the police officers questioning him as to why he was being detained or prevented from travelling to the US.

Ilham Tohti has been subjected to regular surveillance, interrogation and house arrest in Beijing. He and his family have also been previously targeted with travel bans. In October 2012 he was sent back to his home town in Xinjiang province for the duration of the 18th National Congress of the Chinese Communist Party. In 2010 he reported that he had been denied permission eight times to travel abroad to attend academic conferences.

In 2006 Ilham Tohti set up the moderate Uyghur Online website to discuss social issues involving Uyghur-Han relations, in articles published both in Chinese and Uyghur. Chinese authorities alleged this website played a role in instigating the violent unrest in Xinjiang province in 2009 which left up to 200 people dead. Following this the site was shut down and Ilham Tohti was questioned repeatedly by police who accused him of separatism. He currently runs the Uyghur Biz website which is hosted overseas and is blocked in China.

I believe that the prevention of human rights defender Ilham Tohti from leaving China is directly related to his work in defence of human rights and the exercise of his right to freedom of expression, and constitutes a flagrant breach of his right to freedom of movement.

I urge the authorities in China to:

1) Immediately and unconditionally lift the travel ban imposed on Ilham Tohti, as it is believed this measure has been taken in relation to his legitimate and peaceful human rights advocacy;

2) Guarantee in all circumstances that all human rights defenders in China are able to carry out their legitimate human rights activities without fear of reprisals and free of all restrictions including judicial harassment.
